Laws of Manu vs Code of Hammurabi Essay

The Laws of Manu and The Code of Hammurabi were both discovered documents of two different ancient civilizations. These documents basically told the people of the civilizations what is expected of them and what will happen if they don’t follow them. The Laws of Manu were the laws made for the people of India while the Code of Hammurabi were the laws made for the people of Babylon. Both the Laws of Manu and the Code of Hammurabi concentrated a majority on the aspects of marriage, family, and laws of the land. In my opinion, The Code of Hammurabi was harsher than The Laws of Manu. The Code of Hammurabi was for all the people no matter what class they were classified in, even though slaves and women were mostly treated like property in all places at this time. The Code of Hammurabi was also made more as what is morally right and to help maintain order in the civilizations; while the Laws of Manu were made more on the religious side and to promise the people eternal life if they followed these laws. The Code of Hammurabi gave more of an â€Å"if you don’t follow these rules you will just die† tone to it. The Code of Hammurabi was also straight forward and to the point, while the Laws of Manu gave more detail. In the Laws of Manu they get in more depth of every aspect of people’s lives. In chapter two, number 57, it states, â€Å"excessive eating is prejudicial to health, to fame, and to bliss in heaven; it prevents the acquisition of spiritual merit, and is odious among men; one ought, for the reasons, to avoid carefully. † That’s telling people how much they should eat. The laws of Manu are basically telling people how to live their lives in every aspect and if you don’t you won’t have eternal life. The laws also have different rules based on what caste the people are categorized into; the higher the caste, the more privileges. In Chapter five, number 32 it states, â€Å"A Brahmana, having got rid of his body by one of those modes practiced the great sages is exalted in the world of Brahinan, free from sorrow and fear. † The laws promises if you obey these laws you will never feel any pain and just happiness. It also put all Brahmanas on a high pedestal and a lot of the laws do not apply to them. In Chapter 10, number 103, â€Å"By teaching, by sacrificing for, and by accepting gifts from despicable (men) Brahmanas (in distress) commit not sin, for they (are as pure) as fire and water. The Laws of Manu has more religious purpose behind it than, the Code of Hammurabi. The Code of Hammurabi was made more to put order in the Babylonian civilization and it also is more straight forward. Even though it has religious reasons and was made by a very religious man, it was still mostly made to keep order in the civilization. The Code of Hammurabi even addresses how much things can be bought and sold for. Number 239, â€Å"If a man hire a salor, he shall pay him six gur of corn per year†, another example is number 243, â€Å"As rent of heard cattle he shall pay three gur of corn to the owner. The Code of Hammurabi also has more of a revenge seeking tone to it. Just in number one is the perfect example for people to get revenge. â€Å"If any one enshare another, putting a ban upon him, but he cannot prove it, then he that ensured him shall be put to death. † Another example of revenge is number 218, â€Å"If an physician make a large incision with the operating knife, and cut out the eye, his hands shall be cut off. † This document for the most part was mostly a way to punish people or bring justice to the people. It also talks about going to court and having cases to justify situations, for example number five, â€Å"If a judge try a case, reach a decision, and present his judgment in writing; if later error shall appear in his decision, and it be through his own fault, then he shall pay twelve times the fine set by him in the case, and he shall be publicly removed from the judge’s bench, and never again shall be publicly removed from the judge’s bench, and never again shall he sit there to render judgment. † This also goes to show that The Hammurabi Code punished anybody from doctors and lawyers, to women and slaves, your social class did not matter. Surprisingly to me, they both had women rights in there as well. The Laws of Manu gave more freedom to women but yet the Code of Hammurabi gave women more protection. In number 130, â€Å"If a man violates the wife of another man, who has never known a man, and still lives in her father’s house, and sleeps with her and be surprised, this man shall be put to death, but his wife is blameless. In the Laws of Manu, chapter eight, number 364 it states â€Å"He who violates an unwilling maiden shall instantly suffer corporal punishment; but a man who enjoys a willing maiden shall not suffer corporal punishment, if his caste be the same as hers. Not only does that show justice for women but gave women freedom to have casual sex and from the context clues of the Code of Hammurabi, it was frown upon and not classy. Women still didn’t live independent in both civilizations. Also, in both civilizations women were under control by a man from birth to death. Before marriage it is her father, during marriage it is her husband, and at old age it is her son(s). In the Laws of Manu, Chapter nine, number 14, â€Å"Women do not care for beauty, nor is their attention fixed on age; (thinking), ‘(It is enough that) he is a man,’ they give themselves to the handsome and to the ugly. You can also tell that both societies take marriage and respect serious. Unlike in this day and time, the wife gets nothing if divorce is approved. In the Code of Hammurabi number 141, â€Å"If a man’s wife, who lives in his house, wishes to leave it, plunges into debt, tries to ruin her house, neglects her husband, and is judicially convicted: if her husband offer her release, she may go on her way, and he gives her nothing as a gift of release. If her husband does not wish to release her, and if he takes another wife, she shall remain as a servant in her husband’s house. In the Laws of Manu it shows that the Indian society did not have age limits on marriage. In chapter nine, number 94, â€Å" A man, aged thirty years, shall marry a maiden of twelve who pleases him, or a man of twenty-four a girl eight years of age; if (the performance of) his duties would (otherwise) be impeded, (he must marry) sooner. † Both documents were made to control people and both wer e harsh compared to what we know and live today. They both inform us of how life was back then and how time changes. Some things are still used in today’s societies, like the how women should always remain classy. In the Laws of Manu it states in chapter nine, number 13, â€Å"Drinking (spirituous liquor), associating with wicked people, separation from the husband, rambling abroad, sleeping (at unseasonable hours), and dwelling in other men’s houses, are the six causes of the ruin of women. Also in the Code of Hammurabi, number 110, â€Å"If a sister of a god open a tavern, or enter a tavern to drink, then shall this woman be burned to death. † Even though they are from different places they still have the same concept and purposes.

Terms of reference: This report was commissioned by the lecture of Management and Organisation Behaviour as individual assessment on four external forces that can currently affect Organisation for these modules within the Bachelor of Business Degree in Management. Introduction: In this assignment I will present a brief literature review of the main four external forces that can currently affect an organization (a business). First I will introduce global economical powers that influence the four external forces after that I will then introduce the four forces in more detail. Global perspective As the world is emerging from the waters of deep economical crisis I think the best to start with are global influences that affect the main four forces. Each organization is directly strongly influenced by general laws of economics: Economic growth – is influenced by various factors such as development on stock markets, which is strongly influenced by political activities around the world, prices of raw materials (metals, oil etc.) but also prices of energy and future of the economical development in general. Inflation – increases cost of operations and price of products and reduces employment. Interest rates – as many businesses operate with money borrowed from banks changing interest rates influence directly interest expense, which influences the cost of operations and the cost of product PEST Macro analysis Each local business is based in a certain environment that directly influences its performance. The environment a company exists in has a strong impact on every aspect of the company`s life. The following main four macro-economical external influences are interdependent. Political atmosphere – each country has a specific political atmosphere, political culture. For instance countries of the EU would have very different atmosphere to North Korea. Local political decisions shape the countries economical perspective and enable or disable, speed up or slow down the development of local businesses. Political decisions directly influence law of the country (region) and some of them such as economic reforms make strong and long-lasting impact on local businesses. Even political decisions such as annual budget or introduction of income levy  have profound impact on business performance. However this would be more applicable in Adam Smyth`s times. Currently we can still apply this influence of local politics on small or local businesses but the late seventies and eighties of the 20th century, started especially in the Euro-American civilization process of progressive economic liberalization that resulted in supra-national corporations that we know today. Many of these corporations are wealthier then countries they operate in and often dictate what the local political milieu will be. This route would eventually lead us to the question of monopolization and to the question of economic and political interests and their balance. Ultimately it is both international and local law that that create balance between these two areas.1 Great example of politics and law (even if enforced by the international public rather than by local corrupted politicians) impacting on businesses is from India, where supra-national companies producing clothing completely ignored health and safety regulations in order to produce more and cheaper. Unfortunately this lack of political ethic and responsibility resulted in tragedies and loss of many lives. Social environment – main characteristics of social environment are social norms and cultural and even religious preferences. Max Weber sees the protestant idea of hard work as a result of original sin as the inspiration for development of hard-work and profit focused capitalism. 2 This idea of hard-work and profit focused capitalism combined in Europe and in the North of America with culturally well established system of banks borrowing finance for interest resulted in today`s macro economical models. Euro-American banking system is historically based in certain interpretation of oral Torah called Mishna that allows borrowing money for interest in return. It was in historical Europe traditionally â€Å"allowed† only to the Jewish nation as a form of discrimination and punishment. So the development of economy is we know it today would be very unlikely in many parts of the world simply for cultural and religious reasons as in some countries would be money coming from interest prohibited.3 Demographic profile of social environment is crucial for any business existing within that particular society. Gender, age, ethnicity, language, education, public opinion and norms influence every aspect of business. Gender norms define approach of  society towards male / female work.4 In many societies is female work traditionally under-rated therefore from the perspective of operations management it is cheaper for companies to employ women in certain positions. Education of population leads us into the next factor that affects business†¦ Technological development – is a result of the impact of education in the local social environment; technological changes always initiated further development. The invention of wheel accelerated speed of movement of our ancestors, the invention of metals improved their farming instruments as well as weapons but here we are not talking about the long time gone past. Today we live in exciting times of technological changes, which are changing the face of businesses on daily basis. Internet and electronic communication speeded up every aspect of business from operations, logistics to client services. Even the smallest local newsagent or grocery shop must keep up with the development of recent technologies. 20 years ago it would be absolutely unthinkable to top up phone credit while paying for grocery in a local shop. In fact there was no topping up credit at all today. Today we would find it rather odd if our local newsagent (if we still buy newspapers) would not have a top up terminal. Purchasing a flight used to be in general one to one experience; we used to go to travel-agents or flight-companies directly and purchased flights. Today we find normal to use the internet at home even to check in before our flight. A flight company that would not offer internet service to purchase a flight would not survive today. But all this technological progress would not be possible without investments, without wealth. Economical environment – wealth as a source of investment was based in times of Adam Smyth and his An Inquiry into the Nature and Causes of the Wealth of Nations in productive powers of Labour, in accumulation and employment of stock, in progress of opulence in different nations (which is the distribution of wealth between cities and countryside) and in a system of political economy. 5 Today is material wealth accumulated not so much in nations but more so in supra-national companies. Still effective investment is the fuel of business development. Economical environment and wealth  depends as we already mentioned on macro-economic factors of global economic growth, inflation and interest rates that directly influence local currency inflation and interest rates increase or decrease. Often situations lead a person to a sense of despair which causes emotional stress and trauma. There should be a proper approach to the depressed persons in order to get them out of that situation. They often feel that they are boring and blame themselves for being in that situation. This might be due to lack of proper support system required for an individual in the situation of emotional agony. Giving the example of the situation the girl is in, the author says â€Å"the depressed person always apologized for dragging them down or coming off as boring or self-pitying or repellant or taking them away from their active, vibrant, largely pain-free long-distance lives† (P). They also think that talking to others during depression can make others feel bored. Therefore, most of the depressed individuals like to be alone and isolated. More interaction with such people can help to improve their situation. A great deal of compassion and emotional attachment should be there to deal with depression. Many people are of the notion that depression is a kind of mental illness. This might be because they hear lot of stories and news on depressed people doing weird and horrifying acts. Therapists believe that depressed people do not like to mention their situation in details. They sometimes give only the outline of their emotional agony. People suffering from mental illness always suggest that others are being too harsh in this situation and most of them eventually break down in tears. The author further tells the audience that â€Å"her support system often told the depressed person that they just wished she could not be a little less hard on herself, to which the depressed person responded by â€Å"bursting involuntarily into tears† (Wallace 58). A person in depression is most vulnerable and any comments can affect their mental situation badly. Frequent talking to friends in such situations can make them feel bored and less responsive. Moreover, they take down notes while someone is speaking. Taking down notes can sometimes distract the speakers attention, thus some speakers prefer to give handouts to allow the audience to respond well during a lecture. However, in the video clip, we see that by looking at the speaker while writing, the teachers are still able to maintain the rapport with each other. Therefore, the gesture of taking down notes does not affect the communication process in this particular situation.
